THIS IS RICHIE'S APPEAL:
To whom it may concern,
At approximately 18:15 BST on Tuesday 3rd August 2010, my account “Volvics” was banned on the basis of “suspected fraud”. Firstly, I am confused about how one can merely “base” a ban on “suspect” behaviour of any kind. I was under the impression that any ban issued by Moderators was subject to an evidential requirement and I have never heard of anyone being banned on the basis of mere suspicion. This is my first angle of appeal – what evidence do you have and indeed, why was I banned with what can only be circumstantial evidence? One imagines that a lack of evidence negates any ban issued on my account.
Secondly, I am appealing on the basis that I did not commit the offence suggested. I understand that to commit fraud one must intentionally deceive another for personal gain. I fail to see where this has happened? I was taking bets in a casino, created by myself, where I took a bet from an individual who wished to play the casino game “poker” – an adaptation of real life poker on Habbo. During this game, I bet him by getting a number of “fives” whereas he got a number of “fours”. Five is the higher number and, as such, I won. Following this win the individual from whom I took the bet attempted to claim that I had scammed him. I carefully took the time to explain the rules of the game, and had the support of another user in the room (Nixt) who had witnessed the game and had therefore, witnessed by win.
I must stress that the user was not scammed and I successfully won the bet. Furthermore, he gave me the furni and therefore bet at his own risk; unfamiliarity with the rules of the game really does not suggest I had scammed. Equally, I was under the impression that casino bets are taken and made at the risk of the user and as the furni in question is willingly given away, Moderators can take no action (this is not to say I did anything wrong, this was just my understanding which aids my appeal further in negating the ban).
I ask that you look into the evidence surrounding the situation and either;
a) Supply me with the reasoning behind the ban, with solid evidence rather than suspicion.
b) Lift the ban as I believe it to be unfair, and I feel the chat logs and evidence supplied will verify that.
